General rental conditions
- DEFINITIONS: Lessor: the company that leases the vehicles called Target Rent Italy s.r.l., with headquarters in 94015 Piazza Armerina (EN), Via Filippo Guccio n. 11, P.I. 03926470240, Customer: the contractor, be it a natural or legal person, whose exact data are better described and indicated in the title page of this document (Lease Agreement), which duly signed, constitutes an integral and substantial part thereof; subject to which the lessor will name and deliver the tax document. Party or Parties: impersonally, separately, or jointly with the Lessor and Customer; Contract: jointly, these General Contract Conditions and the Lease Contract, duly completed and signed; Rental: the service that the Lessor, upon payment and under further conditions better described in the Contract, undertakes to perform in favor of the Customer. Car and / or Motor vehicle and / or vehicle: the vehicle for the transport of people and / or things, better described and identified in the Lease Agreement which is the subject of the Rental service. Driver and / or other drivers: the subjects who may use the vehicle covered by the contract, even if other than the Customer, as long as they hold a suitable driving license and are identified at the time of delivery of the vehicle by means of the Lease Agreement. The vehicle cannot be driven by persons not expressly declared to the Lessor. Insurance coverage: the leased vehicle is insured for third party car liability, as required by the relevant legislation in the country, the same vehicle is registered, with a single ceiling exceeding the legal limits. The insurance policy does not cover damages suffered by the driver. The policy conditions are available at all rental stations of the Lessor. Any additional optional insurance coverage must be expressly agreed between the parties and inserted in the title page of this contract. Tari ff ario: detailed description of the costs and any further service, including insurance, relating to the rental of the vehicle, displayed at the offices of the Lessor which the customer / party / driver has read and accepted; prices, costs and amounts must be understood as all plus VAT.
- OBJECT OF THE CONTRACT – 2.1. By signing this Contract, the Lessor undertakes to rent the vehicle covered by the contract to the Customer under the conditions set out below. 2.2. The Lessor follows the preparatory activities necessary to allow the Customer the full and efficient use of the vehicle object of the The preparatory activities consist in checking the functionality of the vehicle covered by the Contract. In any case, the Lessor undertakes to deliver the vehicle with fuel, safety equipment (by way of example but not limited to, reflective vest, triangle, spare tire or repair kit, etc.), as well as the regularity of the compulsory insurance coverage RCA, for which the Lessor undertakes to deliver the relevant certificate, a copy of the insurance mark and the green card, together with a copy of the registration certificate.
- DELIVERY AND COLLECTION OF THE VEHICLE – 3.1. The contractual relationship begins on the day and time of delivery of the vehicle to the Customer and ends on the day and time of the return of the vehicle to the Lessor. 3.2. The Customer declares that, before assuming custody, he has examined the vehicle covered by the rental agreement, recognizing that it is in perfect state of use and maintenance, that the instrumentation as well as the mechanical and electronic systems are efficient, that the vehicle is complete safety equipment and circulation and insurance documents. The Customer is obliged to promptly report, by filling in the damage form of ff ormi, and in any case before using the vehicle, any anomalies, damage and defects found on the vehicle to the Lessor by making a written note on the original of the contract in the box called Danni Di ff ormi . All damages and / or defects and / or anomalies that the Lessor will find when the vehicle is returned, excluding those noted on the contract at the time of delivery of the vehicle, will be attributed to the customer who will be obliged to reimburse the costs of restoration. Damages, defects and anomalies, not reported at the time of delivery of the vehicle and found at the time of the return of the same, will be noted in the box called Check-in. At the end of the lease and in particular when the vehicle is returned, the customer is obliged to wait for the Target Rent Italy staff to check the conditions of use and maintenance o f disputes arise between the parties regarding the presence of defects, damages and anomalies, only those noted in the box called “check out” will not be charged to the customer. The costs to restore the defects, anomalies and damages found at the time of return of the vehicle will be communicated to the customer within the non-peremptory term of days. 30 from the return of the vehicle through the e-mail address indicated by the customer at the time of delivery of the vehicle; the latter is in fact required to correctly communicate their personal contact details and identification data. The costs to quantify the extent of damage, defects and anomalies will have a fixed cost of Euro 61.00 + VAT which will be added to the costs of restoration and technical shutdown. For the payment of the restoration costs, please refer to art. 5 of this contract. 3.3. The vehicle can be driven by the Customer or, if indicated on the front of this Rental Agreement, by the second driver, provided that both are over 18 years of age and a maximum of 75 years as long as they are in possession of a valid driving license issued for at least 12 years. months that enable you to drive the rental vehicle. A fee of € 50 up to the age of 24 or € 30 over the age of 75 may possibly be applied. Driving licenses printed in characters other than the Latin alphabet (Arabic, Chinese, Japanese, Cyrillic, etc.) must be accompanied by an international driving license. Furthermore, it is specified that Target Rent Italy reserves the right not to provide the car in the event that it considers the documents presented by the driver to be insufficient and / or untrue and / or The vehicle cannot be driven by other people, unless previously authorized in writing by Target Rent Italy. The customer, under penalty of total responsibility, must take delivery of the goods and observe the diligence of the good father of the family in using it (pursuant to art. 1587 and art. 1176 of the Civil Code) and in any case it cannot be used for: a) transport illegal goods (smuggling, drugs, dangerous goods etc.); b) the transport of passengers against payment expressly or tacitly agreed upon, for illegal purposes, for speed competitions, course trials or races of any kind; d) go abroad except in cases previously authorized by Target Rent Italy; e) purposes of sub-rental and / or careless reliance on third parties for any reason; f) driving under the e ff ect of alcohol and / or drugs, in a state of unconsciousness, in altered psychophysical conditions and / or in contrast with the rules of the Highway Code. 3.4. The vehicle is delivered to the Customer as per Check Out and must be returned in the same conditions in which it was delivered (except for normal wear and tear), at the Target Rent Italy offices, in the reserved stalls, on the day and at the time indicated herein. Rental agreement. If Target Rent Italy requests the return of the vehicle, before the expiry of the contract, for his own administrative / commercial needs, the driver is obliged to deliver the vehicle to the exit branch or to the Target Rent Italy office closest to him, by and no later than 72 hours from the request, except for compensation for damage caused by failure to deliver on time. With reference to the normal return of the vehicle, it is specified that this must take place on the day and at the time indicated in this Rental Agreement. The return must take place on the days and during the opening hours to the public of the Target Rent Italy rental station indicated in the title page of the contract. The Customer is obliged, upon delivery, to request the signature of a Target Rent Italy employee on the Check-in report in which the actual state of the car and the fuel level are reported. In the absence of the aforementioned signature and therefore also in cases where the return takes place during the public closing hours of the rental station, the determinations documented by Target Rent Italy will be valid and tacitly accepted. If damage is found on the vehicle at the time of delivery, Target Rent Italy will inform the customer by sending the photos and the relevant appraisal issued by an independent certification body by e-mail. If the customer does not give any feedback within 3 (three) days of receiving the e-mail, Target Rent Italy will charge the compensation penalties through the customer’s credit card (estimate of the damage, management of the claim, technical stop, damage management , depreciation of the vehicle). If the deposit amount authorized upon delivery of the vehicle is insufficient to cover the repair and penalty costs, Target Rent Italy is authorized to request the greater amount from the customer through the same credit card. 3.5. The vehicle must be returned to the required rental station it is indicated on the contract when the contractual relationship began and on the date and then foreseen in the booking. If the Customer wishes to change the terms of the return (place, date, time), he must obtain the prior written consent of Target Rent Italy by making a request to the latter at least 24 hours before the date established for the return. In the absence of authorization, once the 59-minute tolerance for return has been exceeded with respect to the scheduled date and time, the extra days will be billed at the highest Standard daily rate published on the site in the current price lists, and also in the event of the vehicle being returned in a rental center, in the Italian territory, other than that provided in the booking and not authorized by Target Rent Italy, a compensation penalty will be applied, without prejudice to the contractual conditions established in point 7 of this rental agreement. The cars can be returned abroad only with prior authorization issued by Target Rent Italy at the time of booking confirmation. This service is subject to special tari ff action based on the country of the expected return, as indicated in the Terms and Conditions. 3.6. If at the time of returning the vehicle, the keys of the same are not returned, due to loss or for any other reason or if they are returned damaged and / or tampered with, the customer is required to pay a compensation penalty as indicated in point 6.8; unless he proves that the damage is derived from a cause not attributable to him as provided for by Article 1588 of the Italian Civil Code. The same compensation penalty will also be applied in case of loss and / or deterioration of the license plate, of the registration documents and of the equipment of the vehicle itself.
- PAYMENT GUARANTEE FOR THE SERVICE / RENTAL –
4.1. The Customer and / or the driver and / or the invoice holder must provide Target Rent Italy with valid forms of guarantees for the payment of the services as well as for any additional additional costs. The Customer and / or the driver and / or the invoice holder will be able to provide these guarantees exclusively through a financial credit card. The Customer and / or the driver and / or the invoice holder authorizes Target Rent Italy to bind on the credit card indicated in the rental agreement the sum agreed upon upon delivery of the vehicle and indicated in the “credit card guarantee” box.
4.2. The Customer and / or the driver and / or the invoice holder authorizes Target Rent Italy to bind to the credit card indicated in the rental agreement all the amounts relating to fines and transfer costs, paid parking, motorway tolls, non-delivery of accessories, smells deriving from cigar or cigarette smoke, refueling, insurance deductibles for damage or theft, mechanical, upholstery and bodywork damage caused to the vehicle during the rental detected after the return of the vehicle,
4.3. The Customer and / or the driver and / or the holder will have no objection in case of withdrawal of the agreed amount from the credit card.
4.4 Target Rent Italy Srl reserves the right not to accept credit cards, whose expiry dates are less than 30 (thirty) days from the closure of the rental contract. 4.5 If the customer has booked a car through a broker or website www.targetrent.it, the name on the credit card must always correspond to the name of the voucher holder. - OBLIGATIONS OF THE LESSOR. 5.1. The Lessor undertakes to deliver the vehicle in perfect condition and suitable for the agreed use, recognized as such by the Customer by signing the Contract, complete with the equipment referred to in the previous art. 2.2; 5.2. The Lessor undertakes to reimburse the Customer only for the costs and expenses incurred during the Rental for vehicle breakdowns as long as they are expressly authorized in writing and documented by a suitable tax document in the name of the Lessor. The Lessor will not be obliged to reimburse costs and / or expenses incurred by the customer if they have not been previously authorized in writing. 5.3. The Lessor undertakes to guarantee the customer the replacement of the vehicle circulating on the national territory in the event of mechanical failures and / or road accidents during the contractual relationship; the replacement of the vehicle will not change the economic conditions of the original contract except for any specific requests of the customer that change the content of the The replacement vehicle will be made available to the Customer only and exclusively at the Lessor’s branches. If the breakdown and / or damage that caused the technical stop of the vehicle is due to negligence and / or inexperience of the customer / driver, Target Rent Italy can immediately terminate the contractual relationship for just cause. In the case of vehicles circulating abroad with express authorization from the Lessor, the replacement of the vehicle can take place through the Lessor’s partner, only by purchasing the accessory I CROSS BORDER for the entire duration of the rental. This last form of guarantee is not provided if the vehicle circulates outside the national territory without the prior authorization of Target Rent Italy. 5.4 The cars can be driven without additional costs in all European Union countries and in Norway, Switzerland and the United Kingdom but insurance coverage and roadside assistance are valid only in Italian territory. Therefore, in the event of an accident or theft of the vehicle, the deductible reduction/elimination services and roadside assistance are not applied and the customer will be considered entirely responsible for accidents, damage, theft, technical downtime and any recovery costs. Alternatively, the customer can use the “Abroad Assistance Kasco Validation” Package through which, with a supplement, the customer has the possibility of validating any insurance package purchased, and/or the “Abroad Road Assistance” Package with which the customer extends roadside assistance also abroad (exclusively in permitted countries). Anyone who does not have the “Abroad Road Assistance” supplement will have to repatriate the vehicle at their own expense even in the event of breakdown of the vehicle, regardless of any negligence on their part. The serious fault of the customer (for example: incorrect fuel or proven negligence) is excluded from the coverage of these packages.5.5. The Lessor is not responsible for goods and/or things found inside the vehicle at the time of return .
- OBLIGATIONS AND RESPONSIBILITIES OF THE CUSTOMER ROAD CLAIMS COMPENSATION FOR DAMAGES AND FIRE. 6.1. The Customer undertakes to: a) check the conditions of use and maintenance of the vehicle at the time the asset is taken into custody; b) check the presence on the vehicle of the safety equipment and of the vehicle and insurance documents; c) guard the vehicle with the utmost care and diligence of a good family man; d) do not smoke and consume food inside the vehicle; e) not to carry pets on the vehicle without specific written authorization from the lessor and in any case in compliance with art. 169 of the Highway Code; f) not to transport goods and / or things on the vehicle if the vehicle does not have their specific intended use; g) to drive the vehicle in full compliance with all the laws governing road traffic; h) return the vehicle to the lessor with a full tank of fuel or with the same quantity indicated at the time of the start of the rental relationship; i) take care of the ordinary maintenance of the vehicle during the rental with the diligence of a good family man by carrying out periodic checks of the engine cooling fluids, the engine lubrication fluid, the pressure and wear of the tires, the braking system and lighting; j) to obviate any contravention and / or violation of the Highway Code contested by the Customer during the rental period and to notify the Lessor at the time of returning the vehicle. If the violation is tested by the Lessor and is attributable to the rental period in question, the same will be not managed with an increase in expense charged to the Customer as a compensation penalty. k) the payment of motorway tolls (as well as by way of example and not limited to public and private car parks, fuel costs etc.) during the rental period. If these costs are requested from the Lessor and these are attributable to the rental period, they will be not managed with an increase in expense charged to the Customer as a compensation penalty. l) not to drive or otherwise use the vehicle outside the national territory without prior and express written authorization by the Lessor; if the lessor grants the authorization to travel to one of the following foreign countries: GERMANY, SAN MARINO, FRANCE, SPAIN, SWITZERLAND, AUSTRIA, CROATIA, SLOVENIA, LUXEMBOURG, BELGIUM, LIECHTENSTEIN, NETHERLANDS m) not to drive or otherwise use the vehicle outside the national territory in countries where the Green Card of Civil Liability is not valid and therefore undertakes to compensate for any direct damage and / or indirect resulting from road traffic; n) to provide any useful information, including confidential information, for any communication relating to the contract; o) not to transport goods and / or people and / or things on the vehicle covered by the leasing contract for remuneration and / or remuneration; p) not to lease the vehicle covered by the lease to third parties unless expressly authorized by the Lessor; q) not to push or tow other cars or objects with the vehicle covered by the lease; r) not to allow the vehicle covered by the lease to be driven by a person without a valid driving license and for the country in which it is being driven; s) to drive or have driven the vehicle covered by the lease under the influence of drugs, narcotics, alcohol or psychotropic substances; if the vehicle is driven by people who do not possess the prescribed psychophysical requirements, it will be the responsibility of the Driver to prove that the vehicle was driven against their will; t) not to use the vehicle covered by the lease for races, competitions or speed tests and in any case for a purpose contrary to the law and the rules governing road traffic in the country in which it is driven. 6.2. The Customer declares to be responsible for direct and / or indirect, present and future damages caused to the Lessor and / or to third parties due to its non-fulfillment of the obligations assumed in the previous point 6.1; 6.3. In any case, the Customer undertakes to compensate the Lessor for damages deriving from: a) technical stop of the vehicle to carry out repairs deriving from the Customer’s negligence and / or responsibility; b) the costs incurred by the Lessor for the recovery of the vehicle by tow truck and / or for its repatriation from a foreign country; c) for damages to third parties and to transported persons for an amount greater than those provided for by law; d) for damages affecting the driver; e) for damage affecting objects and luggage carried in the vehicle; f) for damage caused in any way to: electro-mechanical parts, roof, interior, underbody, chassis, vehicle wheels, windows, locks, tarpaulin or camber and collisions without counterparts, vandalism, atmospheric events. I) The Customer is also obliged, by way of partial reimbursement for downtime of the car, to a daily compensation equal to the rate of the daily rental for each day the vehicle is stopped until it is restored.
6.4. In the event of vehicle breakdown, the driver is obliged to contact the assistance service indicated by the Lessor and to inform the latter of the breakdown within a maximum of 12 hours. 6.5. The Customer also undertakes, in the event of a road accident deriving from his / her total or partial responsibility, or in the event of an accident without a counterparty, to compensate the Lessor for any damage occurring to the vehicle covered by the rental contract. The vehicle is insured for civil liability towards third parties and for damage to animals and things within the limits imposed by the law and regulations in force in the country in which the car is registered. In the event of a road accident, the Customer must in any case pay the Lessor a sum as compensation penalty corresponding to the value of the vehicle and / or the damage caused to it.
6.6. The Customer can limit the amount of the compensation penalty for damages for which he is responsible by purchasing the BDW (Basic Damage Collision Waiver) service, which excludes tires, glass, underbody and roof, and in this case the amount of the deductible and the deposit. it is limited (but not reset) or reset the amount of the compensation penalty for damages for which it is responsible up to a predetermined value in tari ff a, included with the CDW (Collision Damage Waiver) service. These services refer exclusively to bodywork damage. Any other damage caused to the car, which is not foreseen by the BDW and CDW services, will be the sole responsibility of the customer. In the event of damage caused to the vehicle, the customer is responsible, in addition to the compensation penalty, for the cost of producing the technical estimate of the damage. This sum is equal to Euro 61.00 plus VAT in addition to the damage found upon return and technical stoppage. In the event of an accident, the Customer undertakes to protect the interests of the landlord and his insurance company by obliging himself, inter alia, to: a) provide the names and addresses of the parties and the number plates of the vehicles involved in the accident, as well as the personal details of any witnesses; b) give immediate notice of the accident by telephone to the lessor, even in the event of minor damage, by sending a detailed report accompanied by a diagram. Pursuant to art. 1913 of the Italian Civil Code and of Law 26/02/77, N. 39, the Customer has the obligation to report the accident to the lessor by unilateral report or by means of an accident report form signed by the drivers involved in the accident, within 3 (three) days from the occurrence of the same or. Failure by the Customer to comply with this obligation will render inoperative the additional services of SCDWE, SCDW, LCDW subscribed by the latter;
- c) immediately inform the police authorities in case of need for investigations against third parties or in the event that there are injured persons. The Lessor does not guarantee in any case the replacement of the freight vans and strictly forbids their expatriation unless expressly authorized by the rental station. 6.8. The customer acknowledges that the rental will end on the date and time of receipt of the vehicle and its keys by the Lessor, and that failure to return them at the end of the rental will result in a compensation penalty of Euro 395.00. It is also understood that if the return of the vehicle and its keys have been authorized by the Lessor during the closing time of the rental office, the rental will end on the date / time of reopening of the rental office. 6.9. The customer is obliged to use the antifreeze additive, where necessary and required by climatic conditions. The customer will have to compensate the lessor for damages related to the possible freezing of the fuel, as well as reimburse him for all costs incurred for the recovery of the vehicle, including any cost of the technical shutdown even if he has signed the ancillary guarantees. Furthermore, the customer undertakes to use the snow chains provided in the vehicle where required by law. 6.10. In case of injection of unsuitable fuel for the vehicle engine, the customer will be held responsible for all damage and expenses incurred for the possible recovery of the vehicle, including any cost of the technical stop, therefore, he will be required to make the payment even if he has signed the ancillary
6.11. In the event of damage to the electromechanical parts, interiors, frame, locks, tarpaulin or ribs, the customer will be obliged to compensate the lessor for all administrative expenses, expenses incurred for the restoration of the vehicle including any cost of the technical stop, regardless , by the limit charged by way of compensation penalty or by the signing of ancillary guarantees. 6.12. In the event of an accident with another car, or of autonomous damage, the customer is obliged to issue a detailed declaration regarding the events that led to the damage to the car. In the absence of such declaration regarding the events, and / or partial declaration and / or incomplete compilation of the CAI form and / or regular complaint filed with the competent authorities (for damages deriving from total / partial theft, total / partial fire, vandalism , damage to the locks), the customer remains responsible for the full value of all damage caused to the vehicle, the cost of administrative expenses, in addition to the technical stop, or a sum determined according to the official rates in force on the rental contract, equal to the amount due if the rental had continued for a period equal to the time necessary for the execution of repairs and the procurement of spare parts. In this case, the payment of the rental service is due up to the date of delivery of the copy-report, to the agreed conventional extent and reported on the Lease Agreement, thus regardless of the limit charged as compensation penalty or the signing of ancillary guarantees.
6.13. The customer is in any case responsible for any damage caused to the locks even if he has signed the ancillary guarantees. 6.14. The customer is responsible for any damage caused by vegetation, even if he has signed one of the ancillary guarantees. Such damage they are comparable to the customer’s negligence in driving the car on country roads or in places where vegetation can cause scratches or damage to the vehicle. The customer must compensate the landlord for all damages caused. 6.15. The customer is responsible for any damage attributable to vandalism even if he has signed the ancillary guarantees. 6.16 The technical stoppage will be charged for a maximum duration of 15 (fifteen) days of rental
- RETURN OF THE CARS PENALTY COMPENSATION FOR DELAYED DELIVERY. 7.1. The Customer undertakes to return the Vehicle to the place, date and time indicated in the Lease Agreement or in any case as soon as the Lessor requests it, with the same accessories and in the same condition in which it was delivered, except for normal wear and 7.2. The Customer is required to promptly notify the Lessor of any delay or impediment relating to the return of the Vehicle. A delay without charge of 59 minutes with respect to the delivery time agreed and indicated in the Lease Agreement is tolerated. After this deadline, any renewals must be renewed rtati on the contract by the Lessor. In the event of non-retrieval, breach of contract or unjustified delay in returning the Vehicle, the Lessor reserves the right to block it through the satellite protection system, make a report for embezzlement to the competent authorities and regain physical possession of the vehicle. in any way, even against the will of the customer. 7.3. The Customer undertakes to pay the Lessor, upon delivery, the agreed sums, tari ff per kilometer, tari ff per time, any additional charge in case of delivery in a place other than the agreed place, VAT and any contribution to bring back to the original level of the fuel tank, including a fixed minimum charge of € 25.00 or according to the ff ario rate in force on the rental contract, for the refueling service as well as the amount corresponding to any fines and any compensation penalties for delay delivery. 7.5. The Customer undertakes to return the vehicle cleaned both in the internal and external parts. Otherwise, the Customer is obliged to pay a compensation penalty proportional to the level of cleanliness of the Vehicle itself, for an amount of Euro 30.00 or 70.00. The determination of the amount will be at the sole discretion of Target Rent Italy staff. Target Rent Italy also reserves the right to charge higher amounts for the restoration of the vehicle’s hygienic conditions, where necessary. 7.6. If the odometer is tampered with or broken when the vehicle is returned, the tari ff per kilometer will be determined on the basis of an average daily distance of 300 km at the unit price of Euro 0.39. The daily rate defines a period of 24 hours or fraction from the moment of delivery of the Vehicle to the Customer. 7.7. The Customer who uses the credit card to pay for the Rental authorizes, by signing the Contract, the debit of the above sums to the current account of reference. The security deposit is mandatory. It must be issued when completing the contract before collecting the vehicle. In the event that, upon returning the vehicle, damage is found to the vehicle itself, this deposit will be retained by the Lessor as a compensation penalty provided for in the contract, without prejudice to the right to obtain further compensation for damages and the application of the relative penalty. and technical stop. Damages will be quantified according to the attached grid and displayed at the rental desk. Otherwise, it will be compensated, in whole or in part, with the sums due to the Lessor as consideration for the rental. This deposit must guarantee the collection of both the rental and any compensation penalties provided for in the contract. The Lessor reserves the right to request, at the time of signing the contract, the authorization on the customer’s credit card to guarantee the total amount given by the amount of the vehicle rental and the compensation penalties provided for in the contract. In the event that the Customer accepts the service of elimination or reduction of compensation penalties, a deposit will be requested at the time of signing the contract to guarantee the rental amount and / or other extras and / or compensation penalties. For any rental made in cash with the authorization of the Lessor, the amount of the rental and the deposit and / or the compensation penalty provided for in the contract will be due in advance. 7.8. The Customer who pays for the Rental by prepaid voucher is in any case jointly and severally obliged, with the issuer of the voucher itself, to pay any amount contractually due in the event of total or partial uncollectability of the security. 7.9. Whoever signs the Contract in the name or on behalf of a third party is jointly and severally liable for the obligations contractually assumed. 7.10. The car must be returned by parking it in the stalls reserved for Target Rent Italy S.r.l., otherwise the Lessor reserves the right to apply compensation penalties for parking outside the authorized places 7.11. The procedures related to the termination of the contract can last up to 60 minutes. 7.12. We are not responsible for the operations related to the transfer to and from the airport as they are carried out as a mere courtesy.
- OBLIGATIONS IN THE EVENT OF A CLAIM – THEFT. 8.1. In the event of a claim, the Customer must: a) inform by telephone the Lessor without delay, by completing all its parts and sending the C.A.I.form in the following 24 hours. (friendly statement signed by both parties) attached to the documents delivered together with the vehicle; b) inform the nearest Public Security authority; c) take note of the names and addresses of the people and the number plates of the vehicles involved in the accident as well as the personal details of any witnesses; d) provide the Lessor with any useful information; e) follow the instructions that the Lessor will provide regarding the custody and repair of the vehicle. 8.2. In the event of theft of the vehicle, the Customer undertakes to report the fact to the competent Public Security Authority and to deliver an authentic copy of the report to the Lessor. In this case, the payment of the rental service is due up to the date of delivery of the copy-report, to the conventional extent agreed and reported on the Lease Agreement. Together with the copy-report, the Customer is obliged to return the vehicle keys as well as the anti-theft remote control to the Lessor if the vehicle is thus 8.3. Theft: The Customer is responsible for the value of the vehicle in the event of total or partial theft and / or fire. The customer can contractually limit the amount of the compensation penalty provided by purchasing the TP (Theft Protection) service. By purchasing the TP service, the Customer will be able to totally eliminate the compensation penalty except for the reason for the above reasons (theft of regions at risk and / or fire).
8.4. The Customer and / or driver remains fully responsible for the total compensation of the vehicle plus any other compensation penalties in the event of failure to return the keys even if he has purchased TP services. The optional coverages will be operational on condition that the Customer has paid the lessor the additional daily quota foreseen in the tari ff a affixed in the Lessor’s offices. The conditions of all the aforementioned policies are available for inspection at the Lessor’s registered office. 8.5. In the mutual interest we invite our kind customers to park the car in guarded areas. 8.6. The customer is responsible in case of theft, if the vehicle is not found, upon payment of n. 30 DAYS RENTAL plus a full tank of fuel, TIME REQUIRED TO CLOSE THE THEFT, even if the accessory guarantees have been signed. If the vehicle is found before 30 days, the customer is still responsible for the rental until discovery plus any damage to the vehicle.
8.7. In case of loss and / or damage of the accessories delivered during the check-out phase, the customer will be obliged to pay the Lessor a penalty indicated on the front page of the rental agreement based on the accessories delivered.
- 9.1. This rental agreement is governed by Italian law, in the event of a conflict in the interpretation between the Italian version and any courtesy translation of this rental agreement, the Italian version will prevail over the others. 9.2. The Lessor, insofar as it is pertinent, authorizes the Customer to use the Vehicle, for the purposes referred to in the Contract, in all countries where the insurance green card is valid.
9.3. No changes may be made to the Agreement except in writing and with the consent of a representative of the Lessor with a suitable power of attorney. 9.4. In case of delayed payment, to be understood as such that made by the Customer at any time after the one in which the car is returned, the Lessor will be entitled to interest for the delayed payment in the amount specified in Legislative Decree 231 / 02. 9.5. For anything not expressly regulated by the Contract, the provisions of the law apply. 9.6. Any changes, modifications, updates to the General Contract Conditions, the Lease Agreement and the Tari ff ario will be made known to the Client in a suitable and legal form.
- The vehicle, if booked, must be collected within 59 minutes of the time agreed upon during the booking process. After this term, the Lessor does not guarantee the availability of the same at the rental branch. Should the collection take place after the time of delivery of the vehicles, the Lessor reserves the right to ask for a fee for the service offered. The customer who books a vehicle through the website www.TargetRent.it, pays as a deposit a sum equal to 20% of the rental amount, including extras. This sum will be retained by the Lessor as a compensation penalty for failure to collect, cancel or modify not accepted by the Lessor.
- The exclusive place of jurisdiction for any dispute relating to the validity, interpretation, execution or ec ssation of the Contract is exclusively competent the court of Catania.
